EB-5 Visa Process Timeline

1. Initial Investment

   1 - 3 Months

   Make qualifying investment of $800,000 or $1,050,000 depending on TEA designation (does not include legal/admin/processing fees ~$150k)"

2. File I-526 Petition

   1-2 months"

   Submit comprehensive business plan and source of funds documentation

3. Concurrent Filing (I-485 & I-765)

   ~3 months for EAD

   File adjustment of status and work permit applications. Receive EAD card allowing employment flexibility

4. I-526 Adjudication

   ~12 months

   USCIS processes and reviews investment petition while you may work with EAD

5. Conditional Residency

   2 years

   Receive conditional green card and maintain investment and job creation requirements

6. File I-829 Petition

   ~24 months

   Submit evidence of investment maintenance and job creation

7. Permanent Residency

   Permanent

   Receive permanent green card upon approval

8. Investment Recovery

   3+ years

   Investment is returned around the 5 year after initial filing - risk can vary greatly based on project.
